Terms of Service

Effective Date: 2025-04-14By downloading, installing, or using the Noto application (hereinafter referred to as the "Application") provided by BateloLabs (hereinafter referred to as the "Service Provider", "we", "us", or "our"), you agree to comply with and be bound by the following Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Application.The Service Provider may update or modify these Terms from time to time. Any updates or changes will be posted within the Application or on the Service Provider’s website, and the new Terms will take effect upon posting. It is your responsibility to review these Terms periodically.1. Acceptance of Terms
By accessing or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Application.2. License to Use the Application
Subject to your compliance with these Terms, the Service Provider grants you a non-exclusive, non-transferable, revocable license to install and use the Application for personal, non-commercial use on your mobile device.3. Restrictions
You may not:- Modify, reverse-engineer, decompile, or disassemble the Application- Attempt to bypass any security measures in the Application- Use the Application for any unlawful purpose or in any manner that violates the rights of others- Copy, reproduce, or redistribute the Application except as explicitly authorized by the Service Provider- Use the Application to transmit harmful or unlawful content, including but not limited to malware, viruses, or unsolicited messages4. User-Provided Content
The Application may allow you to input, submit, or transmit content (such as text or feedback). By submitting content, you grant the Service Provider a worldwide, royalty-free, and non-exclusive license to use, modify, and distribute that content solely for the purpose of improving the Application and its services.You represent and warrant that you own or have the right to submit any content and that it does not violate any third-party rights, including intellectual property rights or privacy rights.5. Speech Recognition
The Application utilizes the built-in speech-to-text functionality provided by Android and iOS operating systems. All audio processing is handled directly by the operating system’s official APIs, and the Application does not record, store, or transmit any audio or transcribed text.You agree to use this feature responsibly and acknowledge that the Service Provider has no access to or control over the data processed by the device’s operating system.6. Third-Party Services
The Application may contain links or integrations to third-party services, including Google Play Services and RevenueCat. These third-party services are governed by their own privacy policies and terms of service. You agree to review and comply with the terms of such services when using them.The Service Provider is not responsible for the functionality or privacy practices of any third-party services.7. Noto Pro Subscription (In-App Purchases)
The Application offers a premium subscription service called Noto Pro, which provides access to additional features. Noto Pro is available in the following subscription plans:- Monthly Subscription- Annual SubscriptionThese subscriptions are managed and processed through Apple’s App Store (iOS devices) and Google Play Store (Android devices), in accordance with their respective payment systems.By subscribing to Noto Pro, you acknowledge and agree to the following:- Payment: All subscription payments are processed through Apple or Google’s payment systems. You may be required to provide your payment details to the App Store or Google Play Store, which will handle all financial transactions.- Subscription Term: The subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your payment will be charged to your iTunes or Google Play account at confirmation of purchase and will automatically renew unless you cancel your subscription before the renewal date.- Free Trial (if applicable): If the subscription includes a free trial, the terms of the free trial, including its duration, will be disclosed at the time of subscription. If you do not cancel the subscription before the trial period ends, you will be charged for the subscription at the applicable rate.- Cancellation: You can manage or cancel your subscription through the App Store or Google Play Store at any time. After cancellation, you will continue to have access to Noto Pro until the end of your current billing cycle.- Refunds: All payments are non-refundable except as required by law. Please refer to Apple’s or Google’s refund policies for further details.8. Account Termination
The Service Provider reserves the right to suspend or terminate your access to the Application at any time, with or without cause, if you violate these Terms or for any reason at the Service Provider’s sole discretion.You may also delete your account or uninstall the Application at any time. Termination of your account will not affect your obligations under these Terms.9. Privacy
Your use of the Application is also governed by our Privacy Policy, which can be found here. By using the Application, you agree to the collection and use of your information in accordance with the Privacy Policy.10. Disclaimers and Limitations of Liability
The Application is provided "AS IS", without any warranties or guarantees of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.The Service Provider does not guarantee that the Application will meet your requirements or be uninterrupted, error-free, secure, or free from viruses or other harmful components.To the fullest extent permitted by law, the Service Provider is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Application.11. Indemnification
You agree to indemnify, defend, and hold harmless the Service Provider, its affiliates, employees, and contractors from and against any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Application or any violation of these Terms.12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service Provider operates, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the Service Provider's jurisdiction.13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.14. Entire Agreement
These Terms, along with the Privacy Policy and any other legal notices published by the Service Provider in connection with the Application, constitute the entire agreement between you and the Service Provider with respect to the Application and supersede all prior agreements, communications, and understandings, whether written or oral, regarding its use.15. This Privacy Policy applies to the Noto app (hereinafter referred to as the "Application"), developed by BateloLabs (hereinafter referred to as the "Service Provider") and offered as a Freemium service. This service is intended for use “AS IS.”Information Collection and Use
The Application collects limited information when you download and use it. This information may include:- Your device’s Internet Protocol address (e.g., IP address)- The pages or screens within the Application that you visit- The date, time, and duration of your usage- Your device’s operating system and versionThe Application does not collect precise location information from your mobile device.Speech Recognition
The Application utilizes the built-in speech-to-text capabilities provided by Android and iOS operating systems. All audio processing is handled entirely by the respective platform’s official APIs. The Application and the Service Provider do not record, transmit, or store any audio or transcribed text. This ensures that your spoken input remains private and is processed only locally by your device or the underlying platform services.Personally Identifiable Information
The Application does not request or collect personally identifiable information such as your name, email address, phone number, or contacts unless explicitly provided by you for support or feedback purposes. Any such data, if shared, will be used solely to respond to your request and will not be stored, shared, or used for any other purpose.Third-Party Services
The Application may use third-party services that collect limited and anonymized data to help improve functionality and performance.
